In trademark, you'll hear about two types of clearance: a "knockout" and a "comprehensive" clearance. We’re introducing a third type—the Thanks Mom clearance.

The three types of clearance differ significantly in scope, legal analysis, cost, turnaround and the level of confidence they provide. What you need is a clearance that lets you know the real risks before you invest heart, time, money, and momentum into a brand and leads you to a solid course of action.

So, what's the difference between (1) a "knockout" clearance (sometimes called a "preliminary" clearance), (2) a "comprehensive" clearance, and (3) a Thanks Mom clearance?

Knockout Clearance:

What:

It's a quick screening designed to identify obvious obstacles in the federal trademark register at the USPTO. It typically looks for existing trademarks that are identical or highly similar to the trademark you want to use. Example: You want to trademark NIKEE for footwear. A knock-out search for NIKEE would pick up that the NIKE trademark is owned by Nike, Inc. Hard pass. You probably won't want to mess with Nike.

What's Missing:

This is only meant to be a light assessment of trademark risk. While it will typically pick up identical obstacles on the USPTO register, it generally does not investigate common-law rights, state registrations, marketplace uses, domain names, social media activity, or other factors that create likelihood-of-confusion, registrability, or litigation concerns.

A knockout search doesn't provide confidence that a trademark is "clear" to register or to use without getting sued.

Why Use It:

It's just an early screening tool to help narrow a list of candidate names, logos or phrases under your consideration before investing in more marketing cycles. Many law firms charge around $1,000 per class for a knockout search, with up to a week or more turnaround.

Comprehensive Clearance:

What:

It provides a full risk assessment before you commit to a name, image, or phrase, evaluating similar spellings, pronunciations, rhythms, visual impressions, design elements, symbolism, meanings, related goods and services, marketplace crowding, and other relevant factors. It extends beyond USPTO-registered marks to common-law uses, and also covers more remote risks, such as foreign translations, and dives into closed content worlds where possible, like certain private marketplaces.

What's Missing:

Very little is missing from a comprehensive search. But turnaround can run two weeks or more, with law firms charging $5,000 and up per class.

Why Use It:

It provides confidence that even the most difficult-to-find risks have been considered, including the needle-in-the-haystack, once-in-a-blue-moon risk; still, these remote risks rarely change the decision, and the coverage often exceeds what the moment requires. A comprehensive clearance earns its cost where the stakes justify eliminating every last unknown, e.g., a category where any dispute would be existential. For example, a comprehensive clearance is more likely to catch a company that serves mostly local customers, does little or no online advertising or SEO, or has little to no web presence.

Unlike a comprehensive clearance, it may not review state trademark records (though more is coming on that soon), online marketplaces, or foreign translations that could affect enforcement and litigation risk; still, that incremental risk is unlikely to change the recommendation.

The report is a point-in-time clearance assessment to help you make an informed decision. We cannot guarantee a particular outcome at the USPTO, or that no third party will assert a claim against your use of a mark.

Once your report is delivered, the matter is complete. If you have a clarifying question that calls for additional attorney work, we'll ask you to start a new matter or refer you to outside counsel — purchasing a clearance recommendation does not include ongoing legal advice.

You can access your report as long as you have an active Thanks Mom account. We recommend downloading your PDF when you receive it.

Pricing is shown at checkout. The base fee (plus taxes) covers a recommendation in one class of goods or services. If you need more than one class (an additional fee applies per added class) the system will calculate it before you pay.

Since Thanks Mom involves legal services provided to you by an independent lawyer, a conflicts check is required by law. Before Thanks Mom accepts any matter, the matter is screened for conflicts of interest with the lawyer's existing clients and matters. This is a standard ethical obligation and protects everyone involved.

If we cannot proceed, we will decline the matter and refund your order in full. We don't share specific reasons because conflicts often involve confidential information about other clients.

Conflict checks usually clear within a few hours during business hours.
