General Trademark Questions

What is a trademark?

A trademark is a name, logo, phrase, or design that identifies your brand and distinguishes it from others in the market. It’s the legal foundation of your brand identity—and often one of your most valuable assets.

What does “trademark clearance” actually mean?

Trademark clearance is the process of figuring out whether your brand name, logo, or slogan is available to use and register (own), before you invest in it.

That means: searching trademark databases and other sources to identify existing marks, writings, and images that may be similar in name, appearance, meaning, or commercial impression — and applying legal tests and human judgment to assess potential risk.

Why is clearance essential?

Building a brand without clearance is one of the most common (and costly) mistakes you can make. Best case, your trademark application is rejected and you go back to the drawing board.

Worst case, you risk:

  • Being forced into an expensive rebrand after launch
  • Getting legal threats or lawsuits
  • Losing your trademark application
  • Wasting marketing, branding and product investment

Either way, it’s expensive, disruptive, and avoidable with the right upfront work.

Can’t I just search Google or the USPTO database myself?

You can, but it’s not enough. We use advanced tech to comprehensively search at a speed and scale that humans scrolling databases can’t.

And, critically, trademark clearance isn’t just about finding identical matches. It requires analyzing:

  • Similar-sounding or visually similar marks
  • Related goods and services
  • Market context and likelihood of confusion

This kind of legal risk analysis is typically performed by trademark lawyers–at high law firm rates.

How Trademark Clearance Works

What goes into a proper trademark clearance?

A comprehensive clearance usually includes:

  • Searches of registered trademarks and pending applications
  • Review of common law uses (brands not formally registered)
  • Analysis of similar marks (not just identical ones)
  • Evaluation of legal risk (likelihood of confusion)
  • Recommendations on whether and how to proceed

It’s not just a database search—it’s about legal judgment and understanding risk.

Is trademark clearance a “yes or no” answer?

No.

Clearance is a risk assessment, not a guarantee. It helps you understand:

  • How risky a mark is
  • Why it could be risky
  • What your options are

From there, you (and your lawyer) decide how to proceed.

What is a class?

Trademarks are registered by the official USPTO category your goods or services fall into (like clothing, software, or legal services), called a "class.” Choosing the right category (or categories) is what makes your trademark meaningful and defensible.

Our lawyer-trained AI suggests the right class or classes  based on your mark, industry, and intended use, so your coverage fits your strategy.

Thanks Mom goes further by:

  • Applying real legal judgment to analyze risk

  • Providing structured, actionable recommendations

You’re getting actual legal services–not just data–and at a low cost.

Are the answers on this page legal advice?

No, the information on this page is for general guidance and is not legal advice

Will the Lawyer-in-the-Middle represent me before the USPTO or a court regarding my trademark?

No. Your representation by the Lawyer-in-the-Middle is limited in scope to your trademark clearance and ends once Thanks Mom delivers your clearance report. See your terms and conditions for more details.

With Thanks Mom, you can:

  • Run comprehensive trademark searches (text + image)
  • Identify similar marks and potential conflicts
  • Get risk analysis validated by real lawyers-in-the-middle
  • Generate exportable clearance reports

How do I get started?

Try it out:

How fast are results?

Our customer commitment is 2-4 business days from when your intake information is complete (your mark name and your goods and services / class selection) and your order passes our internal conflict screening. If anything will push delivery past 2-4 business days, we will email you proactively.

Business hours are Monday through Friday, 9:00 am to 5:00 pm U.S. Eastern time, excluding U.S. federal holidays.

What is included in the clearance report?

Each report includes:

  • Relevant similar marks
  • Risk ratings and legal analysis
  • Class and goods/services insights
  • Clear recommendations on next steps

The report covers your mark, with the goods or services you specified. It includes search results, a risk assessment, and citations.

How will I receive my report?

Two ways: (i) by email with a secure, time-limited link to the PDF and (ii) in your Thanks Mom customer portal, where it's available for re-download for the retention period in our Terms & Conditions.

Can I add a class after I order?

Yes, you can add a class via goods & service selection for an additional fee.

Is the report a guarantee that my mark is available?

The report is a point-in-time clearance assessment to help you make an informed decision. We cannot guarantee a particular outcome at the USPTO, or that no third party will assert a claim against your use of a mark.

Can I ask follow-up questions on my report?

Once your report is delivered, the matter is complete. If you have a clarifying question that calls for additional attorney work, we'll ask you to start a new matter or refer you to outside counsel — purchasing a clearance recommendation does not include ongoing legal advice.

How long can I access my report in the customer portal?

You can access your report as long as you have an active Thanks Mom account. We recommend downloading your PDF when you receive it.

Pricing & Access

How much does a clearance recommendation cost?

Pricing is shown at checkout. The base fee (plus taxes) covers a recommendation in one class of goods or services. If you need more than one class (an additional fee applies per added class) the system will calculate it before you pay.

Is Thanks Mom more affordable than traditional clearance?

Yes.

By automating much of the manual work, and introducing legal judgment at key moments, Thanks Mom delivers:

  • Lower costs
  • Faster turnaround
  • Consistent, high-quality analysis

Can I get a refund?

Refunds are governed by our Terms & Conditions. The most common refund situation is because we cannot proceed because of a conflict of interest (full refund). Email support if you have a concern.

Do you provide automatic credits or refunds for late delivery?

We do not. We work hard to deliver within our 2-4 business day customer commitment, and we'll proactively notify you if we anticipate a delay. If a delay causes a real problem for you, contact support and we'll review.

Conflicts of Interest

Why do you run a conflict check?

Since Thanks Mom involves legal services provided to you by an independent lawyer, a conflicts check is required by law. Before Thanks Mom accepts any matter, the matter is screened for conflicts of interest with the lawyer's existing clients and matters. This is a standard ethical obligation and protects everyone involved.

What happens if my order is flagged?

If we cannot proceed, we will decline the matter and refund your order in full. We don't share specific reasons because conflicts often involve confidential information about other clients.

How long does the conflict check take?

Conflict checks usually clear within a few hours during business hours.

How is my information protected?

Information you provide is treated as confidential. Data handling, retention, and the list of subprocessors are described in our Privacy Policy and Data Processing Addendum. Panel attorneys assigned to your matter are bound by written confidentiality obligations.

Support

How do I reach support?

By email at contact@thanksmom.ai.

We monitor the support inbox during business hours and aim to reply the same business day.
